중소기업 기술침해 자문에 ‘변리사’ 포함: 변리사회 ‘조정대리 허용’ 다시 요청하기로; 2018.11.22 15:58 입력

중소벤처기업부(장관 홍종학, 이하 중기부)가 중소기업기술분쟁 조정·중재위원회(이하 위원회) 운영과 관련해 변리사의 활동범위를 ‘자문’으로만 제한해 논란이 일고 있다. 대한변리사회는 해당 위원회가 재판 절차를 수행하는 것이 아닌 만큼 조정 및 중재의 절차 ‘대리’에 변리사도 포함돼야 한다는 주장이다. 중기부는 지난 9월 공고를 통해 ‘중소기업기술 보호 지원에 관한 법률’의 시행령 일부개정령(안)을 발표했다. 개정안에 따르면 위원회의 시정 권고 또는 공표 전 자문을 받을 수 있는 전문가의 범위에‘변호사, 학자, 산업종사자, 그 밖의 기술보호 관련 전문가 또는 기관’으로 명시해 변리사를 제외시키고 있다. 또 위원회의 조정 또는 중재의 절차 대리인도 변호사로 한정하고 있다. 이에 변리사회는 지난달 말 자문 전문가에 ‘변리사’를 명시해 줄 것과 조정 및 중재 절차 대리인에 변리사를 포함시키는 내용을 포함하는 의견서를 중기부에 제출했다. 중기부는 최근 두 차례에 걸친 답변을 통해 최종적으로 자문 전문가에 ‘변리사’를 명시하기로 했으나 절차 대리는 민사소송법 및 민사조정법에 근거해 변리사 대리를 허용하기 어렵다는 의견을 보내왔다.
